These terms explain how electronic signing works on Signater and your rights and responsibilities when you sign a document received through the Platform.

These Terms for Signers ("Terms") govern your use of the Signater platform ("Platform") as a Signer — the person who receives a link to view, fill in, add attachments to, or electronically sign Documents sent by a Sender. The Platform is operated by the Signater group — Signater LLC (Florida, USA) and Signater Tecnologia Ltda (CNPJ 50.348.626/0001-61, Brazil) — together, "Signater". The entity responsible for the Envelope is the one that contracts with the Sender, as set out in the Terms of Service.
By opening the Signing Link and proceeding with any step of the process, you confirm that you have read and understood these Terms and that you agree to them. If you do not agree, do not proceed, and deal directly with the Sender who sent you the Document.
The relationship between Signater and the Customers who send Documents is governed by the Terms of Service. These Terms apply exclusively to your role as a Signer.
For the purposes of these Terms:
2.1 These Terms apply whenever you open a Signing Link and interact with an Envelope — to view it, fill in fields, add attachments, sign, or decline to sign. The version in force at the time of each access applies.
2.2 Signater does not charge you, the Signer, for using the Platform in the signing process. The cost of the service is borne by the Sender under the Sender's agreement with Signater.
2.3 By using the Platform as a Signer, you represent that you have legal capacity to sign the Document, or that you are duly represented or assisted as required by applicable law.
3.1 Signater is a technology intermediary: it provides the infrastructure through which Documents are sent, authenticated, signed, and preserved with evidence.
3.2 Signater is not a party to the Documents signed through the Platform. Signater does not draft, review, validate, or advise on the content of Documents, and it is not the addressee of the declarations of intent they contain. The legal relationship established by the Document exists between you, the Sender, and the other parties named in it.
3.3 The Sender — not Signater — defines the content of the Document, the signers, the fields to be completed, the signing order, the deadlines, the reminders, and the authentication and identity-verification methods required of you. Questions about the content of the Document or about why a particular verification is required should be directed to the Sender.
4.1 By clicking "Sign" (or performing the equivalent action provided by the Platform), you expressly declare your intent to sign the Document and agree to do so electronically. The confirmation of each field or signature mark in the flow forms part of that declaration of intent.
4.2 Electronic Signatures executed through the Platform are legally valid under applicable electronic-signature laws, including, in Brazil, Provisional Measure No. 2,200-2/2001 and Law No. 14,063/2020, and, where applicable, the U.S. ESIGN Act, UETA, and other applicable electronic-signature laws, producing between the parties the effects the applicable law attributes to a signature of the kind used.
4.3 Before signing, you can view all Documents in the Envelope in full. You may also decline to sign, recording your reason; the refusal and your reason become part of the Audit Trail, which is accessible to the Sender.
4.4 The authenticity and integrity of the signed Document can be checked at the verification address indicated in the Certificate that accompanies the Document.
The Sender chooses, from the methods offered by the Platform, those you must complete to access and sign the Envelope. The methods may include, alone or in combination:
Some methods involve processing images of you — a selfie, a liveness check, a photo of your identity document, and facial comparison. By voluntarily proceeding with those steps, you consent to the processing of that information for the purpose of verifying your identity and constituting evidence of the signature, as described in the Privacy Policy and the AI Terms. Processing is carried out by specialized processors engaged by Signater, listed on the Subprocessors page.
You have the right not to proceed with any verification step. In that case the signing process will not be completed, and you should deal directly with the Sender about alternative means of signing — offering an alternative is the Sender's decision, since the Sender defined the verification requirements.
Identity-document checks, liveness detection, and facial comparison are automated and operate on confidence thresholds. They may reject legitimate captures or documents, or ask you to capture again. You have the right to request review of decisions made solely by automated means, as provided by applicable data-protection law — including Article 20 of the Brazilian General Data Protection Law (LGPD, Law No. 13,709/2018) — by contacting the Sender or Signater at [email protected]. The AI Terms describe how these checks work.
6.1 At each relevant step of the process — viewing, filling in fields, confirming marks, signing, or declining — the Platform records evidence, which may include:
6.2 This evidence serves to constitute, prove, and preserve the authenticity, integrity, and authorship of the signature, and to prevent fraud. It forms the Audit Trail and the Certificate linked to the signed Document and is accessible to the Sender and the parties to the Envelope.
6.3 The signed Document is digitally sealed to the PAdES standard with a timestamp, so that any change made after signing is detectable in compatible PDF readers.
7.1 When enabled by the Sender, the Platform may offer you an AI chat to ask questions about the content of the Documents in the Envelope. When you use it, excerpts of the Documents' content and your questions may be processed by AI providers engaged by Signater, listed on the Subprocessors page.
7.2 Chat responses are informational only, may contain errors or inaccuracies, and do not constitute legal, tax, or professional advice of any kind. In case of any discrepancy, the text of the Document always prevails. The full conditions are in the AI Terms.

You are liable for damages arising from a breach of these duties, including toward the Sender and third parties.
9.1 Documents and evidence are stored with a cloud provider engaged by Signater, with at-rest encryption applied by the storage provider, and all traffic travels over encrypted connections (TLS).
9.2 Documents remain under the management of the Customer who sent them. With respect to the personal data contained in Envelopes — including your data as a Signer — the Customer acts as controller and Signater as processor, within the meaning of the Brazilian LGPD and, where applicable, the GDPR.
9.3 For that reason, to correct, update, or delete data contained in a Document or Envelope, contact the Sender first, as the Sender controls that content. Signater responds to data-subject requests to the extent of its processor role and refers to the controlling Customer those requests that depend on it. Requests to Signater may be sent to [email protected].
9.4 Signing evidence, the Audit Trail, and the Certificate may be retained for as long as necessary to preserve the evidentiary integrity of the signatures and to comply with legal obligations, including after the Envelope is deleted, as described in the Data Retention Policy.
10.1 The processing of your personal data complies with the Brazilian LGPD (Law No. 13,709/2018) and, where applicable, the GDPR, and is described in detail in the Privacy Policy.
10.2 Signater does not sell personal data and does not use Signers' data for advertising. Data is shared with the Sender and the parties to the Envelope, as described in Section 6, with contracted service providers and subprocessors, listed on the Subprocessors page, and with authorities where required by law, subject to the safeguards described in the Privacy Policy.
11.1 The content of the Documents is the sole responsibility of the Sender and the parties. Signater is not responsible for the clauses, conditions, amounts, or obligations set out in the Documents, nor for errors, omissions, or false statements made by any party.
11.2 Signater does not guarantee that a signed Document will be accepted by third parties — such as banks, notaries, public authorities, or courts — since acceptance depends on each institution's policies and requirements and on the specific formalities applicable to each type of act.
11.3 Signater is also not responsible for failures of your connection or device, for incorrect email addresses or phone numbers provided by the Sender, or for legal, commercial, or other decisions made on the basis of the signed Document.
11.4 To the maximum extent permitted by applicable law, Signater's liability toward the Signer is limited to direct damages proven to have been caused by a failure attributable to Signater, excluding indirect damages and loss of profits. Rights that applicable law does not allow to be excluded or limited remain unaffected.
12.1 Signater may update these Terms to reflect legal, technical, or operational changes. Material changes will be announced with reasonable prior notice on the Platform or by other suitable means. The current version will always be available at signater.com/terms-for-signers.
12.2 Each signing process is governed by the version in force when you access the Signing Link. Continuing the process after an update constitutes acceptance of the updated version.
13.1 Where the entity responsible for the Envelope is Signater LLC, these Terms are governed by the laws of the State of Florida, United States, with venue in the courts located in Miami-Dade County, Florida.
13.2 Where the entity responsible is Signater Tecnologia Ltda, these Terms are governed by the laws of the Federative Republic of Brazil, with venue in the courts of the judicial district of Barueri, State of São Paulo, subject to mandatory venue rules, including those that apply to consumer relationships.
13.3 In any case, nothing in these Terms deprives you of mandatory consumer-protection or data-protection rights granted by the laws of your jurisdiction that apply to you regardless of the choice of law and forum above.
14.1 Questions about the content of a Document, about the legal relationship it establishes, or about the verification requirements set for you should be directed to the Sender.
